A BILL to amend article ten, chapter sixty-four of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section four,
relating to authorizing the manufactured housing construction
and safety standards board to promulgate a legislative rule
relating to the Board.
Be it enacted by the Legislature of West Virginia:

That article ten, chapter sixty-four of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section four,
to read as follows:

LEGISLATIVE RULES.
§64-10-4. Manufactured housing construction and safety standards
board.

The legislative rule filed in the state register on the
twenty-seventh day of July, two thousand one, authorized under the
authority of section four, article nine, chapter twenty-one, of
this code, modified by the manufactured housing construction and
safety standards board to meet the objections of the legislative
rule-making review committee and refiled in the state register on
the twentieth day of December, two thousand one, relating to the
manufactured housing construction and safety standards board (West
Virginia manufactured housing construction and safety standards
board, 42 CSR 19), is authorized with the amendments set forth
below:

On page 18, subsection 15.4 by deleting the following proviso:
"Provided, however: When the balance of the Recovery Fund reaches
a balance of one-million dollars or more, the interest revenues
shall be deposited in the Manufactured Housing special revenue
account to be used by the division of labor for routine enforcement
purposes."

NOTE: The purpose of this bill is to authorize the
Manufactured Housing Construction and Safety Standards Board to
promulgate a legislative rule relating to the Board.
